Terms and conditions of use

1. Scope of application
BISE online performs its services exclusively on the basis of these terms and conditions of use. The terms and conditions provided online at any given time apply at the time of your use of our service. We do not accept any regulations differing from these conditions unless they are confirmed by us in writing. By registering with BISE online you are declaring your express agreement with the terms and conditions of use without further explanation.

2. Content/offers, liability
Our own and other companies’ information and product ranges are provided via BISE online.
Those from other companies are identified as such. In the event that you might incur loss or damage through relying on any of the information or details contained therein, which you have obtained through using BISE online, then BISE online shall be liable only in the event that the loss or damage has been caused intentionally or by gross negligence on the part of the legal representatives or vicarious agents of BISE online or if a duty, on whose fulfilment you particularly rely, has been breached through slight negligence (cardinal duty).

In the case of information and product ranges supplied by other companies and by private individuals (e.g., discussion forums) BISE online is technically only providing the medium. Any such content/offer made accessible to you by third parties, is information supplied by the respective originator, author or publisher and as such is not supplied by BISE online. BISE online is therefore not responsible under any circumstances for the accuracy or reliability of the information and offers contained therein. In particular BISE online is not liable for any loss or damage which you incur by relying on such pieces of information.

The inclusion of hyperlinks in our service is only for the purposes of mediating access in the sense of § 5 Para. 3 of the Teleservice Law. Therefore we do not accept any responsibility whatsoever for information contained therein.

3. Copyright, right of use of contents
Copyright, property rights or other rights of third parties, which are accessed via BISE online, remain with the respective holder of the rights to the full extent and are protected accordingly. Unless otherwise determined in a specific case you are legally entitled to produce only a few copies of a proportion of the contents, provided that these copies are only intended for personal use and provided that it is guaranteed that all references to the property rights and their contents continue to exist.

It is forbidden to use the databases listed in BISE online for commercial purposes. Anyone misusing this information will be liable to criminal prosecution.

An online subscription entitles one user on one single PC at any given time to use the database exclusively during the agreed subscription period. For several users or for use on more than one PC, multiple subscriptions are available which stipulate the maximum number of users and PCs. Company licences are governed by special terms and conditions and types of service.

In the case of closed user groups each user is allocated a personal user name and password for his or her workstation in order to gain access. The user is obliged to keep this information confidential and not to pass it on to third parties and to change it if it becomes known to third parties for any reason.

It is forbidden to pass on parts of the contents of the database, including parts, to third parties.

4. Conclusion of contracts for goods and services offered
For deliveries from Springer range we deliver to the postal address we have been given. The dispatch costs incurred are charged at normal market rates. Place of performance is our distributing warehouse. For deliveries abroad the customer bears the increased dispatch costs as well as the additional taxes and duties.
Insofar as goods or services of third parties are offered via BISE online, any eventual contracts come into existence exclusively between you and the party supplying such business. Eventual claims arising from such business transactions are directed exclusively at the supplier. The supplier’s price lists and the supplier’s terms and conditions of subscription, which are valid at the time the order is placed, apply accordingly to all offers.

5. Obligations in dialogues
In using the dialogue-based services of BISE online (e.g. discussion boards) you undertake to restrict your contributions to professional exchange of opinion, to refrain from advertising and to show consideration for the interests of other users. In the event of misuse your contributions may be deleted and your membership blocked.

6. Authorisation of access
We have the right to refuse to allocate user names and passwords or to cancel the access data with seven days’ notice without stating the reasons. This does not affect the right to cancel without notice for good cause, but especially for one of the following reasons:
a) giving false details when registering
b) misuse of our service
c) damage or impairment to the operability of the service
d) other infringements of the terms and conditions of use.
We hereby reserve the express right to assert claims for compensation.

7. Availability
There is no entitlement to total availability of our website. The website may be temporarily unavailable owing to maintenance work or technical faults in particular, without claims accruing against us therefrom.

8. Privacy Policy
We respect the privacy of our users and undertake to handle the personal data of our customers in strict confidence. We gather, process and use your data to implement our service, especially to process purchase orders in our bookshop and to foster ongoing relationships with customers. These data include name, address, bank details, size of company, sector of industry, position and function.

Participating service providers are only given access to your data if it is necessary for the implementation of our service. We provide other companies with your address details if these companies want to send you interesting information. We use only temporary cookies and do so only in the bookshop, in order to check the status of the shopping basket. In the process the cookie is filed temporarily in the user’s main memory. IP addresses or personal user profiles are not stored. We are committed to handling customer data in strict confidence and we also expect the same from our cooperative partners.

9. Other matters
If this contract stipulates that the written form must be used, then sending an e-mail or a fax also constitutes this written form. The law of the Federal Republic of Germany is applicable to all legal relationships ensuing from the use of BISE online.

10. Salvatory clause
If individual stipulations of these terms and conditions of use are not legally effective either wholly or in part or later cease to be legally effective either wholly or in part, the validity of the terms and conditions of use remains otherwise unaffected thereby. The legal stipulations supersede the ineffective regulation. The same applies insofar as loopholes might show up in the terms and conditions of use.

11. Out-of-Court Settlements
We BISE do[es] not engage in out-of-court settlements before consumer arbitration bodies. However, under the regulation (EU) 524/2013 we are obliged to inform you that the European Commission provides a platform for online dispute resolution, which is available at http://ec.europa.eu/consumers/odr/.
